| Florida law requires that all legal ballots be counted. The law defines a legal ballot as one for which the voter's preference can be discerned upon examination. For instance: Suppose a voter punched chads for BOTH Nelson AND Scott; then wrote on his ballot, ''I cast my vote for Nelson.'' The machine would kick out the ballot as an over-vote. But the intent of the voter was to cast his ballot for Nelson. Thus, under FL law, it must be counted as a legal vote cast for Nelson. This is exactly the sort of thing Scott hopes to prevent by DENYING the people of FL the right to have their ballots recounted. |
